Men arrested after canine unit discovers meth

Two men in California were arrested by agents with the U.S. Border Patrol after canine units trained to recognize drugs allegedly detected methamphetamine inside their vehicle on Aug. 21. According to U.S. Customs and Border officials, the traffic stop occurred around 2 a.m. after the two men inside a 2008 Chrysler Sebring were referred to a secondary inspection located at a checkpoint in San Clemente. The vehicle was driven by a 33-year-old man from Mexico, and there was a 22-year-old male passenger onboard as well.

After the dogs alerted agents, the CBP claims to have recovered more than 20 packages of methamphetamine located in the car's rocker panels and 19 vacuum-sealed packages in the gas tank. Officials claim the drugs recovered had a total weight of 78 pounds and a street value of $780,000.

The driver possessed a valid visa but did not have an I-94 permit to allow his vehicle to travel more than 25 miles beyond the border. The Drug Enforcement Administration took the two men into custody on charges for possessing a controlled substance with intent to distribute and for an immigration violation.

A criminal defense lawyer might help mitigate a defendant's penalties or drug charges by challenging the probable cause leading to the arrest. For instance, he or she could determine if the defendant's rights were violated during the investigation or arrest. Police misconduct or mishandled evidence may also warrant a dismissal or reduced sentence. A lawyer may also be successful with challenging the charges by finding facts that could introduce a degree of reasonable doubt. Additionally, in some cases, a reduced sentence or charges may be negotiated in a plea bargain with the prosecutor.
