California man sentenced to 15 years for robbery

A 25-year-old Oakland man recently received a prison sentence of more than 15 years for robbery, use of a firearm and being a felon in possession of a firearm in Alameda County. He has two prior robbery convictions and two other convictions for assaulting correctional officers. The man's criminal defense lawyer requested a new trial and says that the defendant was in a different place when the crime supposedly occurred.

The judge denied the request and criticized the defendant's disregard for women and the community as a whole after the prosecution reported that the defendant swore after his conviction and said that he wanted to have intercourse with a female court employee. The county prosecutor felt he should receive the maximum term because of these statements and because he also reportedly threatened to kill a witness, a bailiff and the bailiff's family. The judge sentenced him to slightly less than the maximum prison term.

The accused man was convicted for robbing a man with a gun by a liquor store in February 2012, along with a co-defendant who has not been arrested. He was shot later by a law enforcement officer who allegedly believed that the defendant had a gun and reached for it as he attempted to escape.

He has filed a $10 million lawsuit against Oakland and the police officer for the violation of his constitutional rights. The suit, which claims that the officer unjustly shot him, was put on hold until the criminal case could be resolved.

After a conviction for multiple charges, the judge has the option to sentence defendants for consecutive sentences. A criminal defense attorney might be able to ask for reduced terms by negotiating with the prosecution.
