Arraignment set for driver in fatal California car accident

A man was taken into custody on charges of driving while intoxicated and vehicular manslaughter following a fatal car accident on Linda Vista Road and Tait Street in San Diego, a little after midnight on Aug. 15, 2013. The accident killed one man and injured another. The alleged at-fault driver is set to be arraigned on DUI charges on Aug. 19, 2013.

Initial evidence indicated that the man had run a red light at the intersection, causing the collision. According to San Diego police, he had been driving a 2001 Toyota pickup truck traveling south and struck a 1994 Mazda sedan that was traveling west. The Mazda's driver was declared dead at the scene, the driver's brother was taken to a nearby hospital for treatment of non-life threatening injuries.

A person facing DUI charges following a car accident with significant injuries or fatalities may suffer severe life-altering consequences if he or she is convicted. The person may have to pay significant restitution, serve time in prison and lose driving privileges. After prison, many people find it difficult to obtain work, housing and transportation.

A skilled California defense attorney may be able to minimize the damage of serious DUI charges. The attorney may carefully review all of the state's evidence in the case and may perform an independent investigation. If there is any questionable evidence or any violations of the defendant's rights, the attorney may challenge the evidence or the entire case in court. If law enforcement has engaged in any misconduct, the attorney might be able to have the case dismissed. If the evidence is flawed in any way, the attorney might file a motion to have the evidence excluded in court. Without crucial evidence, the prosecution may not be able to prove the guilt of the defendant.
