California driver charged in fatal freeway accident

A man who allegedly drove drunk and struck a man who had exited his disabled vehicle was taken into custody on July 28, 2013. The accident occurred on 4:15 a.m. in the slow lane of Ventura Freeway in Encino near the Balboa Boulevard off-ramp, according to the California Highway Patrol.

The man who was killed was standing beside his grey Scion when he was hit by a man in a Toyota 4Runner who allegedly had been driving while intoxicated. Also injured were two female passengers in the Scion. A spokesman for the California Highway Patrol stated that one passenger received critical injuries and the other received minor-to-moderate injuries. Both were taken to area hospitals for treatment. A female passenger in the Toyota sustained minor injuries.

The man who is accused of fatally striking another motorist as the result of driving while intoxicated may face serious financial and personal consequences if he is convicted. He may have to pay substantial restitution to the family of the other motorist. In addition, he might be sentenced to prison, have his license revoked and have a DUI listed on his criminal record.

The first step an attorney may take would be to conduct a thorough review of all evidence in the case. There may be undiscovered evidence that could prove a person's innocence. Additionally, if a Breathalyzer was not properly calibrated or the test was not properly executed, the results of the test might be challenged and ultimately thrown out of court. Without test results, it may be difficult for the prosecution to prove that a person was intoxicated.
