Ice cream truck driver arrested for DUI in Santa Rosa

California Highway Patrol troopers stationed in Sonoma County apparently responded along with Sonoma County Sheriff's deputies to a gas station in Santa Rosa on Oct. 31. The agencies were responding to a call made by a gas station clerk who reported a possible drunk driver in the parking lot.

When officers arrived, they found an allegedly intoxicated 57-year-old Santa Rosa man in an ice cream truck in the lot. Upon investigation, police reportedly determined the man's blood alcohol content was four times the legal limit of .08 percent. The man was arrested and charged.

According to witnesses, the incident occurred around 4:30 p.m. across the street from an elementary school. Witnesses say children were just beginning to trick-or-treat when the man was arrested and charged with drunk driving. No one was injured, and no accidents occurred prior to his arrest. In addition to DUI, the man was also charged with driving without a valid license. Police state the man failed a number of field sobriety tests that were administered to him.

When a person is facing drunk driving charges, the potential penalties can be severe if he or she is convicted of the offense. If the person's blood alcohol content is very high or if they have prior drunk driving convictions, penalties can be increased. It is often advisable for people accused of DUI to seek the advice of a criminal defense attorney as soon as possible. An attorney can help by reviewing all relevant facts, identifying potential defenses and devising an effective defense strategy in the case. Even in situations in which a person has consumed alcohol, they may be able to successfully argue that their consumption did not result in impaired driving.
