Ex-Standford swimmer files appeal for sexual assault conviction

On Dec. 2, a former Stanford University swimmer who was found guilty of sexual assault in California filed an appeal after he finished serving his sentence. The case became well-known after he was sentenced to just six months in jail. He was released after serving three months for good behavior.

The former swimmer was accused of sexually assaulting an unconscious woman at a fraternity house in 2015. The man, who was 19 at the time, was taken into custody after two other students reported seeing the alleged act as it was occurring. After being sentenced to six months in prison, he was required to register as a sex offender in Ohio, his home state.

The man's attorney filed papers in a California appeals court on Dec. 1. In the documents, it was said that the trial prosecutor incorrectly told jurors that the alleged act took place behind a trash bin. The woman in question was found near a garbage enclosure and not behind a trash bin as this would suggest that the former swimmer had attempted to hide the activities. In a statement, the District Attorney for Santa Clara County said that the swimmer received a fair trial and that the conviction would be upheld.

A conviction on sexual assault or rape charges could have a major impact on a person's life and future. In addition to potentially facing jail time, a person convicted on these types of charges will likely be required to register as a sex offender, meaning he or she will be unable to work certain jobs or live in certain places. A criminal law attorney may challenge the accusations and the evidence against the accused person, especially if the testimony and evidence do not match the accusations.
